Terms of Service

These Terms of Service ("Terms") govern your access to and use of Scriptorium.works ("Platform", "we", "us"). By creating an account or using the Platform in any way, you agree to be bound by these Terms. Please read them carefully.
1. Who We Are
Scriptorium.works is a global online marketplace for literary works, editorial services, book cover art, and creative commissions. The Platform connects authors, editors, translators, designers, and readers worldwide.
2. Eligibility
You must be at least 18 years old to create an account and use the Platform. By registering, you confirm that you are at least 18 years of age, you have full legal capacity to enter into a binding agreement, and you are not prohibited from using the Platform under any applicable law.
Users aged 16–17 may use the Platform in read-only mode where permitted by applicable local law, with verifiable parental consent provided in advance.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms, are involved in fraudulent activity, or have been inactive for more than 24 consecutive months after prior written notice.
4. Content You Upload — Ownership & License
You retain full ownership of any content you upload to Scriptorium.works, including manuscripts, texts, images, and descriptions ("Your Content").
By uploading content, you grant Scriptorium.works a limited, non-exclusive, revocable, royalty-free license to: store and display Your Content to facilitate the services described on the Platform; generate technical previews (e.g. blurred excerpt, cover thumbnail) for marketplace display purposes; transmit Your Content to buyers upon completed payment.
This license does not include the right to: use Your Content to train artificial intelligence or machine learning models; reproduce, distribute, or sublicense Your Content beyond what is strictly necessary for Platform operations; modify, adapt, or create derivative works from Your Content without your explicit consent.
This license terminates automatically when you remove Your Content from the Platform, except that copies transmitted to buyers who completed payment prior to removal remain valid under the terms of that specific transaction.
5. Content Standards & Prohibited Content
You agree not to upload, sell, or distribute content that: infringes any copyright, trademark, or other intellectual property right; is plagiarized, fraudulently attributed, or misrepresents authorship; contains defamatory, libelous, or demonstrably false statements about real persons; sexualizes, exploits, or endangers minors in any way; constitutes hate speech; promotes violence, terrorism, or self-harm; was generated entirely by artificial intelligence without clear disclosure; violates any applicable law or regulation.
AI-assisted content (where AI helped but the work was substantially created by a human author) is permitted, but must be disclosed. Fully AI-generated content must be clearly labeled as such.
6. Transactions & Payments
Payments are processed by our third-party payment processor. For each completed sale, the revenue split is: 90% to the seller and 10% platform fee to Scriptorium.works.
Payment processing fees are absorbed by the Platform from its 10% share. The seller always receives at least 90% of the listed price.
Payouts are processed within 7 business days of order completion, subject to applicable identity verification requirements.
7. Refunds & Disputes
Because the Platform deals in digital files that are immediately accessible upon download, sales are generally final.
Exceptions (full refund issued): the delivered file is corrupted, empty, or technically unreadable; the delivered content materially misrepresents the listing description; the seller fails to deliver within the stated timeframe; EU/EEA consumers exercising the 14-day right of withdrawal under Directive 2011/83/EU, provided the digital content has not yet been accessed or downloaded.
Disputes must be opened within 7 days of delivery. Our decision is binding for Platform-internal purposes but does not limit any rights you have under applicable law.
8. Intellectual Property Certificate
The Platform offers a free Authorship Certificate service ("/protect") that generates a SHA-256 cryptographic hash of your uploaded file and records it with a timestamp in our database and on the Bitcoin blockchain via a public timestamping protocol.
This certificate constitutes evidence of the existence of a specific document at a specific point in time and may be used as corroborating evidence in legal proceedings. It does not constitute formal copyright registration with any national copyright office and does not replace registration with the US Copyright Office for purposes of US statutory damages.
We store only the cryptographic hash, metadata, and timestamp — we never store the contents of your file on our servers when using the /protect service.
9. Confidentiality of Unpublished Manuscripts
We treat unpublished manuscripts uploaded to the Platform as confidential. We will not share, display, excerpt, or otherwise expose unpublished manuscripts to any third party except buyers who have completed payment for a specific manuscript, Platform staff reviewing a dispute or copyright infringement claim, or as required by applicable law or court order.
We will never use unpublished manuscripts for AI training, promotional excerpts, or any purpose beyond facilitating the specific transaction for which they were listed.
10. Intellectual Property Infringement (DMCA)
If you believe content on the Platform infringes your copyright, please submit a notice to [email protected] including: a description of the copyrighted work; the specific URL(s) of the infringing content; your contact information; a good-faith statement that the use is not authorized; a statement under penalty of perjury that you are the rights owner.
We will process valid notices promptly. Repeat infringers will have their accounts terminated.
11. Disclaimers
The Platform is provided "as is" and "as available." We make no warranties, express or implied, regarding the Platform's reliability, availability, or fitness for a particular purpose.
We are not responsible for the accuracy, quality, legality, or authenticity of content uploaded by users. We do not verify authorship claims made by sellers.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Scriptorium.works shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
Our total liability for any claim shall not exceed the greater of: (a) the amount you paid us in the 3 months preceding the claim, or (b) €50.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under applicable law.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of Romania and, where applicable, European Union law including the GDPR and the EU Digital Services Act.
For users in the EU/EEA, mandatory consumer protection provisions of your country of residence apply regardless of this choice of law clause.
We encourage resolving disputes amicably by contacting us at [email protected]. EU users may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
14. Changes to These Terms
We may update these Terms at any time. If changes are material, we will notify you by email at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
